The owners’ meeting is part of the mandatory programme for flat owners. This is where important decisions are made about the property for the future. And these affect all owners.
It’s about the common property
By law, an owners’ meeting must take place at least once a year. There are also many other regulations concerning the meeting; if they are not observed, the resolutions passed are sometimes not effective and can be contested.
But what topics are actually dealt with at an owners’ meeting?
Above all, it is about the common property, i.e. topics such as:
- Structural changes such as renovation of the staircase or installation of a lift.
- Special levies
- Maintenance reserves
- Election of the management advisory board
- Appointment of a new property manager
- Discharge of the property manager
- Annual statement of the property charges
- Business plan
Many owners’ meetings were postponed or cancelled because of Corona
With Corona, many meetings were postponed or in some cases did not take place at all. Even after the restrictions have ended, many do not feel comfortable with the idea of sitting in a room with a large number of people. Often, condominium owners are also part of the risk group and fear contagion. But owners’ meetings must still take place and participation is very important. Otherwise you have no influence on the resolutions and may be annoyed afterwards.
New reform of the WEG allows video meetings
The solution: a meeting via livestream. Since the reform of the Condominium Act, online meetings are legally permitted. The reform was urgently needed; there was a backlog of renovations due to lengthy decision-making processes. After the reform, the condominium owners’ association is now responsible for the entire administration. Another important innovation: the meeting has a quorum even if only some of the owners participate.
The new paragraph that regulates the online condominium owners’ meeting is § 23 para. 1 WEG:
“The condominium owners may decide that condominium owners may participate in the meeting even without being present at its location and exercise all or some of their rights in whole or in part by means of electronic communication.”
This means that owners’ meetings can now be held completely online or as a hybrid event and still have a quorum. In a hybrid meeting, one part of the owners meets on site while the other is connected online. In this way, hygiene and distance rules can be observed during the pandemic. Another advantage: a smaller venue is needed and the online participants save time and travel costs.
